News: Pedestrian to get compensation over untrimmed bushes

Pervin Yetkin, aged 54 from Dalston in North London was in an road accident where she was hit by a car as she crossed the road whilst the traffic lights were on green.

Even though at first she was blamed for the accident and could not put in a personal injury claim
against Newham council, she appealed against the ruling as she said the bushes obscured her view.

The court of appeal agreed the bushes obscured her view of the oncoming traffic and were a partly to blame for the accident.

They also said she should be able to claim damages against the council as they owed the public a duty of care and had failed by not trimming the bushes back.

The judges said the council should give her 25% compensation towards the injuries she had suffered.

The amount of compensation she could claim has not been confirmed as yet and is due to be looked at by another court at a later date.
